ASHES 2 WINGS LLC: EQUINE COACHING AGREEMENT, ASSUMPTION OF RISK AND RELEASE

This Agreement applies to the Stack the Run and Saddle Session coaching services provided by Ashes 2 Wings LLC and Ashley Imming, collectively referred to as “Ashes 2 Wings.”

NATURE AND LIMITATIONS OF REMOTE COACHING

I understand that Ashes 2 Wings provides educational coaching based primarily on videos, information, and descriptions that I submit. Ashley is not physically present to inspect my horse, equipment, riding area, ground conditions, physical condition, riding ability, or other circumstances that may affect safety.

Any observations, suggestions, exercises, techniques, or recommendations provided are educational in nature. They are not a guarantee of safety, performance, or results and are not a substitute for instruction from a qualified professional who is physically present when needed.

ACKNOWLEDGMENT OF INHERENT RISKS

I understand that horses are unpredictable animals and that riding, handling, training, exercising, or otherwise working with a horse can result in property damage, bodily injury, permanent disability, or death. Risks may arise from, among other things:

• A horse’s behavior, including bucking, kicking, biting, bolting, rearing, stumbling, falling, or reacting unexpectedly;
• The actions of other animals, riders, people, vehicles, or equipment;
• Uneven, slippery, hard, obstructed, or otherwise hazardous riding conditions;
• Improperly fitted, damaged, or defective tack or equipment;
• My own actions, inexperience, physical limitations, or failure to follow appropriate safety practices; and
• Attempting an exercise or recommendation that is unsuitable for me, my horse, my equipment, or my surroundings.

VOLUNTARY ASSUMPTION OF RISK

I voluntarily assume all inherent and reasonably foreseeable risks associated with riding, handling, training, or working with horses and with choosing to apply information or recommendations provided through Ashes 2 Wings coaching.

I understand that I am never required to attempt a recommendation. I agree to stop and seek appropriate in-person assistance whenever I feel unsafe, uncertain, physically unable, or believe that a recommendation may be unsuitable for my horse or circumstances.

RELEASE OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, I RELEASE AND AGREE NOT TO HOLD ASHES 2 WINGS LLC, ASHLEY IMMING, AND THEIR OWNERS, MEMBERS, EMPLOYEES, CONTRACTORS, AGENTS, AND REPRESENTATIVES LIABLE FOR CLAIMS, DAMAGES, LOSSES, OR INJURIES ARISING FROM THE INHERENT RISKS OF HORSE-RELATED ACTIVITIES OR FROM MY DECISION TO APPLY THE COACHING INFORMATION PROVIDED, INCLUDING CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF A RELEASED PARTY.

This release does not apply to conduct or claims that cannot legally be waived under applicable law.

PARTICIPANT RESPONSIBILITIES

I am responsible for:

• Honestly describing my experience, physical limitations, horse, equipment, and circumstances;
• Using properly fitted and maintained tack and appropriate safety equipment, including a riding helmet when appropriate;
• Determining whether I and my horse are physically and behaviorally capable of performing an activity;
• Selecting a reasonably safe riding or training environment;
• Obtaining veterinary, medical, or qualified in-person professional assistance when appropriate; and
• Following the laws, safety requirements, and accepted equine practices applicable where I live and ride.

Ashes 2 Wings does not diagnose or treat medical or veterinary conditions. Questions involving pain, injury, lameness, illness, medication, or physical fitness should be directed to an appropriate licensed medical or veterinary professional.

WARNING

UNDER TEXAS LAW (CHAPTER 87, CIVIL PRACTICE AND REMEDIES CODE), A FARM ANIMAL PROFESSIONAL OR FARM OWNER OR LESSEE IS NOT LIABLE FOR AN INJURY TO OR THE DEATH OF A PARTICIPANT IN FARM ANIMAL ACTIVITIES, INCLUDING AN EMPLOYEE OR INDEPENDENT CONTRACTOR, RESULTING FROM THE INHERENT RISKS OF FARM ANIMAL ACTIVITIES.

SUBMITTED VIDEOS

I confirm that I have the right to submit the videos and other materials I provide to Ashes 2 Wings. If another identifiable person appears in a submitted video, I confirm that I have obtained that person’s permission, or their parent or guardian’s permission when applicable, to submit the video for private coaching review.

Ashes 2 Wings may use submitted materials to provide the purchased service but may not use them publicly or for advertising without separate permission.

NO GUARANTEE OF RESULTS

I understand that horse and rider performance depends on numerous factors outside the control of Ashes 2 Wings. No particular result, improvement, competition outcome, or level of safety is promised or guaranteed.
